Terms of Service

Last updated: October 24, 2026

1. Acceptance of these terms

By creating an account or using No Red Pen, you agree to these Terms of Service. If you use No Red Pen on behalf of a school or district, you represent that you are authorized to accept these terms on its behalf and that your use complies with your school or district's policies.

2. Account eligibility

No Red Pen accounts are intended for teachers, tutors, homeschool educators, and other adults who grade student work. You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. Student accounts are not offered, and students should not be asked to create them.

You are responsible for keeping your sign-in credentials secure and for all activity that happens under your account. You must provide accurate registration information and keep it up to date.

3. Student data: FERPA and COPPA

No Red Pen is designed to support schools' and teachers' obligations under the Family Educational Rights and Privacy Act (FERPA) and the Children's Online Privacy Protection Act (COPPA).

  • • Your classes, rosters, scanned papers, and grades are visible only to your account. We do not sell student data, and we do not use it for advertising or profiling.
  • • Student work and names are processed only to provide the grading, identification, and reporting features you use. Our AI service processes paper images to grade work and suggest name matches; suggestions require your confirmation.
  • • Where FERPA applies, we act under your direction as a service provider. When a school or district uses No Red Pen, we may be acting as a "school official" with legitimate educational interest, using student data only for the educational purpose the school directs.
  • • Because No Red Pen is used by educators and not directly by children under 13, parental consent under COPPA is obtained — where required — by the teacher's school or program, not by us. You and your school are responsible for ensuring any student information you upload has been collected lawfully and with any required consent.

See our Privacy Policy for details on what we collect and why.

4. Your content and ownership

You keep all rights to the content you create and upload: your assignments, answer keys and rubrics, rosters, scanned student papers, and the grades and feedback you save. We claim no ownership of your content or your students' work.

You grant us a limited license to store and process your content solely to operate the service for you — for example, sending a scanned page to our AI service so it can be graded against your key, or exporting the CSV you request. When you delete an assignment, its papers and scores are deleted with it; removing a roster student deletes their saved handwriting samples.

5. AI-assisted grading disclaimer

Grades, name suggestions, and analytics in No Red Pen are produced with the help of AI and are provided for assistance only. They are not a substitute for your professional judgment.

  • • Your answer key or rubric is treated as the ground truth, but AI grading can still misread handwriting, miss pages, or score imperfectly.
  • • Nothing is final until you approve it: every score, name assignment, and feedback note is editable, and unidentified papers can never be automatically assigned to a student.
  • • We do not guarantee that AI output is complete, accurate, or error-free, and you remain responsible for the grades you record and report.

6. LMS integrations (Google Classroom & Canvas)

No Red Pen can import rosters from and export grades to Google Classroom and Canvas when you connect them.

  • • Connections are authorized by you — through Google's OAuth flow or a Canvas access token you create — and can be disconnected at any time. We store connection credentials only to perform the syncs you request.
  • • We use the permissions you grant only to list your classes, import student names, and post the scores you choose to push. We never take actions in your LMS beyond what you trigger in No Red Pen.
  • • Some schools and districts restrict third-party access to Google Classroom or Canvas. If your district has not approved the connection, those features may not work, and you should follow your district's process before connecting.
  • • Google Classroom and Canvas are provided by their own operators under their own terms; we are not responsible for their availability or behavior.

7. Acceptable use

You agree not to misuse No Red Pen: no uploading content you have no right to use, no attempting to access other users' data, no reverse-engineering or automated scraping of the service, and no using it to violate applicable laws or your school's policies. We may suspend accounts that put the service or other users at risk.

8. Availability, changes, and termination

We work to keep No Red Pen available, but the service is provided "as is" and we do not promise it will be uninterrupted or error-free (see section 10). Features and these terms may change over time; when terms change materially, we will update this page. If you stop using the service, you can request removal of your account and the data stored with it by contacting the No Red Pen team.

9. Subscriptions, billing, and refunds

  • • Free accounts include a limited number of scans each month. The monthly allowance resets at the start of each calendar month (UTC), and unused scans do not carry over.
  • • No Red Pen Pro is billed monthly in advance through our payment processor, Stripe, and renews automatically until you cancel. Prices are shown before you subscribe and may change with advance notice.
  • • You can cancel at any time from Subscription & Usage. Cancellation takes effect at the end of the current billing period, and you keep Pro access until then.
  • • Payments are non-refundable, including for partial months, except where required by law. If you believe you were charged in error, contact billing@noredpen.com.
  • • Usage limits are enforced to protect the service; we may suspend accounts involved in abusive or automated use.

10. Disclaimer of warranties

To the fullest extent permitted by law, No Red Pen is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that grades, name matches, analytics, or exports will be accurate or complete.

11. Limitation of liability

To the fullest extent permitted by law, No Red Pen and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, or grading or academic decisions made using the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the 12 months before the claim arose, or $100 if you have not paid us anything.

12. Indemnification

You agree to defend, indemnify, and hold harmless No Red Pen and its operators from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the service, your violation of these terms, or your failure to obtain any consent required to upload student information.

13. Copyright complaints (DMCA)

If you believe content in No Red Pen infringes your copyright, send a notice to support@noredpen.com that identifies the work, the material you believe infringes it, your contact information, a statement of good-faith belief that the use is unauthorized, and a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner. We may remove infringing material and terminate repeat infringers.

14. Disputes and general terms

Please contact us first so we can try to resolve any concern informally. These terms are governed by the laws of the State of New York and applicable United States federal law, without regard to conflict-of-law rules. Any dispute arising from these terms or the service will be resolved exclusively in the state or federal courts located in New York, and you consent to their jurisdiction. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These terms, together with the Privacy Policy, are the entire agreement between you and us about the service.
